GENERAL TERMS AND CONDITIONS OF SALE

The Be Project SARL, a limited liability company, registered in the commercial register of Geneva under number CH-660.2.698.021-6, with its registered office at 1 Place du Port, 1204 Geneva, Switzerland, represented by its legal representative domiciled in this capacity at the said office.

IMPORTANT

These General Terms and Conditions of Sale (GTC) govern the contractual relations between The Be Project SARL and its client within the framework of a distance selling system through the SITE.

Any order placed on the SITE implies that the CLIENT has read these GTC and accepts them without reservation.

In case of contradiction between these GTC and specific conditions, the latter shall prevail.

Art.1. Definitions

The terms used in these GTC have the following meaning:

  • CLIENT: any person purchasing PRODUCTS on the SITE;
  • DELIVERY: refers to the handover of the ordered PRODUCTS to the delivery address indicated by the CLIENT;
  • PRODUCTS: all products available for sale on the SITE;
  • TERRITORY: Switzerland and the European Union.

Art.2. Purpose and scope

The GTC define the terms of sale, order, payment, and DELIVERY.

The SELLER reserves the right to modify the GTC at any time. The applicable GTC are those in force on the date the order is placed.

The GTC are written in French, the original version, which alone is authentic and prevails over any translation or interpretation.

 

 

 

Art.3. Conditions of sale

3.1 CLIENT

The CLIENT must be at least 18 years old. The CLIENT must provide accurate and up-to-date information and immediately inform the SELLER in case of any change in this information.

3.2 PRODUCTS – Characteristics and conformity

The PRODUCTS comply with Swiss legislation.

The visuals, descriptions, nutritional information, and indications appearing on the SITE are for informational purposes only and are not contractual. Differences may appear between the PRODUCT presented and the PRODUCT delivered. These differences shall not constitute a defect of conformity as long as they do not alter the nature, essential composition, quality, safety, or purpose of the PRODUCT.

Art.4. Orders

4.1 Order procedure

Orders are placed directly on the SITE. No order by mail or email will be accepted. The order process is as follows:

  1. Selection of PRODUCTS: the CLIENT chooses the PRODUCTS and places them in their cart.
  2. Verification of DELIVERY information: the CLIENT verifies their order, provides their billing and DELIVERY information, then chooses the payment method.
  3. Validation and payment: the CLIENT confirms their order and proceeds to pay the price.
  4. Acknowledgment of receipt: the SELLER sends an email acknowledgment of receipt confirming the order, noting the order date.

The order constitutes acceptance by the CLIENT of the prices and product description. Any order can only be considered final upon total and effective payment of the amounts due. Orders validated by the SELLER cannot be canceled by the CLIENT, except with written acceptance from the SELLER and subject to the exercise of the right of withdrawal provided for in Article 5 of the GTC.

The SELLER reserves the right to cancel any order from a CLIENT who does not comply with the terms of these GTC.

4.2 Unavailability of PRODUCTS

The SELLER informs the CLIENT in case of unavailability, within a maximum of 48 to 72 hours and, if possible, offers an equivalent product to the CLIENT. In case of refusal by the CLIENT or lack of response, the SELLER will proceed with the refund of the order within fourteen (14) days.

4.3 Subscriptions

When placing an order, the CLIENT may subscribe to subscriptions offered on the SITE. Subscriptions are concluded for the duration and frequency chosen by the CLIENT when ordering. The subscription begins on the day of its subscription by the CLIENT.

Subscriptions are automatically renewed unless terminated at least five (5) working days before the end of the current period. Termination takes effect at the end of the already paid subscription period, corresponding to the DELIVERY frequency chosen by the CLIENT when subscribing (for example: monthly or quarterly).

The CLIENT can cancel their subscription at any time via their account or by contacting info@the-be-project.com. Termination will take effect at the end of the current and already paid period.

4.4 Price

The prices of the PRODUCTS are indicated in Swiss Francs (CHF) including VAT and do not include DELIVERY costs. DELIVERY costs will be brought to the attention of the CLIENT before final validation of the order. DELIVERY costs and customs duties and taxes, if any, are borne by the CLIENT.

Art.5. Right of withdrawal

5.1 Purchase

The CLIENT benefits from a right of withdrawal of fourteen (14) days from the receipt of the PRODUCT. To exercise their right of withdrawal, the CLIENT must notify their decision to withdraw to the SELLER using the withdrawal form provided in the appendix, by email to: info@the-be-project.com

The CLIENT must return the PRODUCT, at the latest fourteen (14) days after exercising their right of withdrawal, to the following address: The Be Project SARL, 1 place du port, 1204 Geneva, Switzerland.

Opened, unsealed, consumed, or damaged PRODUCTS are not eligible for return. They must be returned intact and in their original packaging. Failing withdrawal under the conditions mentioned, the delivered PRODUCTS will be deemed accepted by the CLIENT.

5.2 Subscriptions

The CLIENT may exercise their right of withdrawal within fourteen (14) days following the first subscription order. Thereafter, the CLIENT may terminate their subscription under the conditions provided in Article 4.3

 

 

 

5.3. Withdrawal policy

Return shipping costs are borne by the CLIENT. The right of withdrawal does not apply to personalized products or products manufactured according to the CLIENT's specifications, likely to deteriorate rapidly or perishable, or any other exceptions provided by law.

In case of withdrawal by the CLIENT, the SELLER undertakes to refund the price of the product(s) within fourteen (14) days after receipt of the returned PRODUCT. The refund will be made via the same payment method used for the initial transaction, unless otherwise agreed by the CLIENT.

Art.6. Payment

6.1 Means of payment

Payment is debited at the time of order. The available payment methods are those offered on the SITE.

6.2 Delay or refusal of payment

In case of error, or impossibility to make the payment, the order will be automatically canceled. Failed payments result in the suspension of the subscription.

6.3 Payment of subscriptions

In case of subscription, the CLIENT can choose to pay by direct debit: monthly, quarterly, or annually when ordering.

The available payment methods are those offered on the SITE. The CLIENT guarantees to be authorized to use the chosen method and is responsible for providing a valid method.

In case of default of payment, the subscription is suspended until regularization.

Art.7. DELIVERY

7.1 DELIVERY zone

PRODUCTS are deliverable in Switzerland and the European Union. For any other destination, please contact us at info@the-be-project.com.

7.2 Shipping time

All orders are prepared within two (2) working days following order validation, excluding weekends and public holidays. Shipping is carried out as soon as this preparation is completed from our warehouse located in Switzerland. An email is automatically sent to the CLIENT at the time of shipment.

7.3 DELIVERY times & costs

Estimated DELIVERY times from shipment are as follows:

  • Switzerland & Liechtenstein: 2–3 working days;- EU: 3–5 working days.

DELIVERY costs and times are displayed to the CLIENT during the order process and are borne by the CLIENT.

7.4 DELIVERY methods

  • Switzerland & Liechtenstein: DELIVERY via Swiss Post or another chosen carrier, without signature.
  • EU: DELIVERY via a local carrier.

7.5 Delay or failure of DELIVERY

In case of absence of DELIVERY within the time indicated on the SITE, the CLIENT may contact the SELLER to agree on a new DELIVERY date.If the PRODUCT is not delivered within thirty (30) days after the conclusion of the contract, the CLIENT may request the cancellation of the order and will be fully refunded, including DELIVERY costs, via the same payment method used when ordering.

7.6 Subscriptions

Periodic DELIVERY is carried out according to the frequency chosen by the CLIENT and to the addresses indicated when ordering.

Art.8. Claims

The CLIENT must check the PRODUCTS upon receipt and notify the carrier and the SELLER (by email to info@the-be-project.com) of any damage, non-conformity, or partial loss within three (3) days following DELIVERY.

The SELLER is responsible for defects of conformity existing at DELIVERY. The CLIENT must notify any defect of conformity as soon as it is discovered.

The SELLER guarantees hidden defects rendering the product unfit for its intended use. The CLIENT must inform the SELLER as soon as the defect is discovered and must provide all justification as to the reality of the non-conformities, damages, or defects found. Subject to this justification, the SELLER will authorize the CLIENT to return the PRODUCTS, specifying the address and return procedures.

The CLIENT may then request, at their choice: a full refund of the price paid or replacement of the product with a conforming product. Return costs will be borne by the SELLER if the defect or non-conformity is proven.

In case of a dispute relating to the products or the contract, the non-professional CLIENT may refer the matter to a consumer mediator, notably the Centre de la Médiation de la Consommation et Conciliateurs de justice: https://www.cm2c.net/.

If the dispute is not resolved amicably, the CLIENT may refer the matter to the competent courts. For a professional CLIENT, disputes will be submitted to the Court of First Instance of Geneva.

Art.9. Liability

9.1 Transfer of risks

The risk is transferred to the CLIENT at the moment of taking possession of the PRODUCT, including if DELIVERY is made to a third party designated by the CLIENT.

9.2 Limitation of liability

The SELLER cannot be held responsible for damages suffered by the CLIENT resulting from:

  • Improper use of the PRODUCT by the CLIENT;- Cases of force majeure;- External third-party sites to which the SITE refers, including their content, services, or functionalities (e.g., PayPal, links to partners, etc.);- Any indirect damage, loss of profits, operating loss, or economic prejudice suffered by the CLIENT, resulting from the use of the products or the SITE.

In case of force majeure, i.e., any unforeseeable, irresistible, and external event making the performance of the SELLER's obligations impossible, the SELLER's obligations are suspended for the duration of the event.

9.3 Use and medical precautions

The CLIENT is responsible for checking the composition of the PRODUCTS before consumption. The PRODUCTS sold are food supplements, intended to supplement the diet and do not replace medical treatment. The SELLER disclaims all responsibility in case of unnotified allergies or intolerances. The CLIENT must consult a health professional before any use in case of doubt.

Art.10. Intellectual property

All elements of the SITE, images, videos, texts, animations, and development of the SITE, are protected by copyright, trademark, and patent law. It is forbidden to copy or use all or part of the content of the SITE, except with clear and express authorization from the SELLER.The latter reserves the right to claim damages in case of infringement or violation of its intellectual property rights.

 

Art.11. Personal data

Personal data is collected and used in accordance with the Swiss Data Protection Act (DPA) and the GDPR, for order management and marketing with the CLIENT's consent. The SELLER undertakes to protect the privacy of its clients and users.

The SELLER collects and processes data necessary for order management, such as name, surname, address, email address, telephone number, and payment information.

The CLIENT's personal data is used exclusively for order processing, product DELIVERY, customer service management, and service improvement. It may also be used to send promotional offers, if the CLIENT has consented.

The CLIENT's data may be shared with third-party service providers (e.g., payment services, carriers) strictly within the framework of order management. The SELLER does not sell or rent the CLIENT's data to third parties for commercial purposes.

The SELLER implements appropriate security measures to protect data against unauthorized access, loss, alteration, or disclosure. The CLIENT has rights of access, rectification, erasure, restriction, portability, and opposition to the processing of personal data.

Art.12. Validity of clauses

If one of the clauses of these GTC is deemed unwritten, all other stipulations remain in force between the parties.
